Nuvalaw Platform – Acceptable Use Policy

1. Introduction

This Acceptable Use Policy (the “Policy”) sets out the rules governing your use of the Nuvalaw platform and its web services (the “Service”) and any content you submit to the Service (“Content”).

Your access to the Platform is provided under the terms of a Services Agreement, Master Services Agreement (MSA), Subscription Agreement, or a substantially similar commercial contract (the "Governing Agreement") between Nuvalaw and your employer or affiliated entity (the "Client"). This Policy is an extension of and is incorporated by reference into that Governing Agreement.

By using the Service, you agree to the rules set out in this Policy. A violation of this Policy by you may be deemed a material breach of the Governing Agreement between Nuvalaw and the Client.


2. Applicability

This Policy applies to all individuals and entities granted access to the Nuvalaw Platform.


3. Prohibited Uses

3.1 General Restrictions

  • Do not use the Service in any way that causes, or may cause, damage to the Service or impairs its availability or accessibility.
  • Do not use data stored on or processed through the Nuvalaw Platform that does not belong to you for any purpose other than enabling the performance of the Service.
  • Do not use the Service in any way that is unlawful, illegal, fraudulent, or harmful.

3.2 Unlawful and Illegal Content

You must not use the Service to store, host, copy, distribute, display, publish, or transmit Content that:

  • Is libelous or maliciously false.
  • Is obscene or indecent.
  • Infringes any intellectual property rights (copyright, moral rights, database rights, trademarks, design rights, passing off).
  • Infringes rights of confidence, privacy, or data protection.
  • Contains negligent advice or negligent statements.
  • Incites the commission of a crime.
  • Is in contempt of court or breaches a court order.
  • Breaches racial or religious hatred or discrimination legislation.
  • Is blasphemous.
  • Breaches official secrets legislation.
  • Breaches any contractual obligation owed to another person.

You must also not submit any content that is or has ever been the subject of threatened or actual legal proceedings or similar complaints.

3.3 Platform and System Security

  • Harmful Software: Do not promote or distribute viruses, Trojans, worms, root kits, spyware, or other harmful technologies.
  • Data Mining: Do not conduct systematic or automated data collection (scraping, data mining, extraction, harvesting) without Nuvalaw’s written consent.
  • Unauthorized Access: Do not access or attempt to access accounts, data, or systems without authorization.

3.4 Marketing and Spam

  • Do not use the Service for marketing, advertising, promotion, or sales.
  • Do not share Spam, defined as any unwanted or unsolicited communication irrelevant to arbitration.
  • Do not send unsolicited commercial communications, chain letters, ponzi schemes, or similar materials.

3.5 Inappropriate and Graphic Material

  • Do not submit Content depicting explicit, graphic, or gratuitous violence.
  • Do not submit pornographic, sexually explicit, or graphic sexual material.

4. User Responsibilities

As a user of the Nuvalaw Platform, you are responsible for:

  • Account Security: Maintaining the confidentiality of your credentials. You are responsible for all activity under your account and must notify Nuvalaw immediately of unauthorized use.
  • Data Accuracy: Ensuring all information you provide is accurate, complete, and current.
  • Compliance: Ensuring your use complies with this Policy, Nuvalaw Terms of Service, and applicable laws and codes of conduct.

5. Monitoring

Nuvalaw does not actively monitor Content, notwithstanding the provisions of this Policy.


6. Enforcement and Violations

Nuvalaw reserves the right to edit or remove Content at its sole discretion. If you breach this Policy, Nuvalaw may:

  • Delete or edit your Content.
  • Issue formal warnings.
  • Temporarily suspend access.
  • Permanently prohibit access.
  • Notify the Client of violations.

Actions will align with the rights and remedies in the Governing Agreement.


7. Reporting Violations

If you become aware of material that contravenes this Policy, please notify us via the Nuvalaw service desk.


8. Modifications to this Policy

Nuvalaw may modify this Policy at any time. Notice of significant changes will be provided. Continued use of the Platform constitutes acceptance of the updated Policy.
